1. Parties and contract documents
Sauvage Adventure Limited, a private company registered in the Astana International Financial Centre (AIFC), Business Identification Number 261040900011, registration date 1 October 2026, address: Republic of Kazakhstan, Astana, Yessil District, Mangilik El Avenue, building 55/23, block C4.4, office No. 334, operates under the Sauvage Adventure brand as a travel agent. Acknowledgement of receipt of the notification of commencement of travel agency activities in the Republic of Kazakhstan: No. KZ22UWG00020101, registration date 6 October 2026 (the “Company”). Company website: https://sauvageadventure.com. Email address for legal notices: [email protected]. Current contact details are provided in the Contacts section of the Company’s website. “Participant” means an individual arranging participation in a programme.
The Company provides intermediary services as a travel agent: it advises on the choice of services and preparation for the trip, arranges bookings, enters into contracts with foreign tour operators and other service providers (each a “Partner”), receives payments and transfers funds to Partners, provides documents and information, and assists with the handling of Participants’ claims. The scope of the contract is limited to intermediary services, which do not constitute a tourist product. The Company is not a tour operator, does not create a tourist product, does not combine separate services into a tour and does not add services to another person’s tourist product. The intermediary services provided by the Company are specified in the offer.
The contract is between the Company and the Participant and consists of the individual offer and these Terms of Use (the “Terms”). The Company enters into the contract in its own name. On the Participant’s instructions and at the Participant’s expense, the Company enters into contracts with the Partner in its own name for the services specified in the offer, for the Participant’s benefit; the Participant does not need to enter into those contracts separately. The Partner and guides do not become parties to the contract between the Company and the Participant merely because they are mentioned in it. The contract is concluded in accordance with section 2 of these Terms. If the individual offer conflicts with these Terms, the individual offer prevails.
2. Application and contract formation
The programme description on the website is an invitation to apply and does not guarantee availability. Before submitting an application, the Participant can review and save the offer for the selected programme, these Terms, the price information, details of the services included and the participation requirements. By ticking the checkbox in the application form on the Company’s website, the Participant agrees to these Terms, acknowledges the Privacy Policy and gives the consents specified in the form. Ticking the checkbox and submitting an application do not, in themselves, reserve a place or conclude a participation contract.
After approving the application, the Company emails the Participant confirmation of approval and a notice requesting payment of the deposit. The offer and Terms provided at the application stage remain available to view and save on the payment page; they do not need to be sent again in a separate email. If the Terms change, the Company expressly informs the Participant of the changes before payment, provides the new version and obtains the Participant’s separate agreement to it. The Participant may decline the revised Terms without a cancellation charge for a contract that has not yet been concluded. Changes after contract formation are governed by section 5 of these Terms.
The contract is concluded and the Participant’s place in the programme is reserved when the Company receives the deposit specified in the offer within the stated payment period. Receipt of the deposit means that the required amount has been credited to the Company’s bank account or to the bank account of a person authorised by the Company to accept payments. A card authorisation hold or a payment success message on the website is not sufficient on its own. Payment constitutes acceptance of the offer and the Terms of Use referred to in it. The Company emails confirmation to the Participant and makes a downloadable PDF available on the status page, containing the individual offer and a link to the immutable accepted version of the Terms of Use. The Terms of Use form part of the contract and can be viewed and saved using that link. Full payment fulfils an obligation under the contract already concluded and is a condition of participation in the programme; it is not the point at which the contract is concluded.
Payment by a third party does not remove the need for the Participant to agree to the Terms. For a group application, the applicant must have authority to share the other individuals’ data; each adult Participant must personally agree to the Terms and give the necessary consents before their own contract is concluded. A minor may participate only with the Company’s written confirmation and with participation arranged by the minor’s legal representative.
3. Contract price and payment
The offer specifies the total contract price, payment currency, deposit and balance, payment deadlines and procedures, and the services included in and excluded from the total contract price. Mandatory charges and known additional costs are disclosed to the Participant before the contract is concluded. The Participant bears their own bank charges and currency conversion costs unless the offer provides otherwise.
The Participant pays the full contract price to the Company. The total contract price comprises the Company’s fee for intermediary services and the funds payable for the Partners’ services. To carry out the Participant’s mandate, the Company enters into contracts with Partners in its own name and at the Participant’s expense.
The deposit must be paid no later than 120 hours after the Company’s manager approves the application, and in all cases before the programme start date and time stated in the offer. The payment page specifies the payment deadline’s date, time and time zone; the payment notice states the rule for calculating the deadline. If the deposit is not received by the deadline, the offer lapses and the Participant’s application is cancelled. A payment received after the deadline does not automatically reinstate the booking: the parties either conclude a contract under a new offer or the Company refunds the payment within five business days of receipt.
The balance must be paid no later than 60 calendar days before the programme starts. If the contract is concluded fewer than 60 calendar days before the start, the balance must be paid within the ten business days following the day on which the deposit is received, and in all cases before the programme start date and time stated in the offer. A different deadline may be specified in the offer before the deposit is paid. The offer must state the payment deadline or the rule for calculating it. For a late booking, the Company communicates the calculated payment date and time after receiving the deposit, without changing the agreed payment period.
Business days are Monday to Friday, excluding official public holidays and other non-working days in the Republic of Kazakhstan. Whenever a time for performing an obligation is stated, the time zone is specified.
If the balance is overdue, the Company notifies the Participant and allows a reasonable additional period for payment, taking account of the programme start date. If payment is not received within that period, the Company may terminate the contract and cancel the booking. Settlement with the Participant is governed by section 4, taking account of the reasons for the delay and mandatory provisions of the laws of the Republic of Kazakhstan. Termination without an additional period is permitted if the breach cannot objectively be remedied before the programme starts and termination is proportionate to the consequences of that breach.
4. Changes or cancellation by the Participant
The Participant may revoke the Company’s mandate by notifying a Company representative through an agreed communication channel or by emailing [email protected], quoting the booking number. The time remaining before the programme starts is calculated when the Company receives the notice, by reference to the start date and time stated in the offer.
For cancellation sixty calendar days or more before the programme start date stated in the offer, the Company refunds the amounts paid, less its fee for intermediary services properly performed and documented expenses incurred in carrying out the mandate.
For cancellation fewer than sixty calendar days before the programme starts, the deposit is non-refundable. Any balance paid is refunded after deducting documented expenses actually incurred by the Company in carrying out the mandate and not covered by the retained deposit. The Company’s fee is included in the retained deposit and is not deducted again.
The Company promptly informs the Partner of the cancellation and takes the necessary steps to recover the funds. Expenses may include amounts lawfully retained by the Partner under cancellation terms provided to and agreed with the Participant before the contract was concluded. Amounts returned or due to be returned to the Company are taken into account when calculating expenses.
These deductions do not apply where cancellation results from the Company’s breach of its obligations. Expenses arising from that breach are not charged to the Participant.
Rescheduling participation or substituting a Participant is permitted by written agreement with the Company, subject to the Partner’s terms. Any additional costs must be agreed with the Participant in advance.
5. Changes or cancellation by the Partner
The Partner may change the route, schedule and services for objective reasons, including weather conditions and safety risks, within the terms agreed with the Participant before the contract was concluded. The Company promptly passes on information it receives about such changes. If the changes require an amendment to the Company’s mandate, that amendment must be agreed with the Participant.
Decisions on the route are made by the Partner’s leader and guides within their authority. Reaching a summit, completing every section of the route, particular weather conditions and visibility are not guaranteed.
If there is a material change to the services before they begin, the Company notifies the Participant and offers the choice of agreeing to the revised scope of services or terminating the relevant part of the contract and cancelling the corresponding booking. The notice specifies a response period that is sufficient in the circumstances and in light of the programme start date. Failure to respond does not constitute agreement.
If the Partner cancels services, the Company promptly requests a refund and settles with the Participant in accordance with sections 4–6 of these Terms. The rule that the deposit is non-refundable when the Participant cancels does not apply to such cancellation. If cancellation results from the Company’s breach, the Company refunds the amounts due to the Participant and remains liable for its own breach regardless of whether it has received funds from the Partner. Cancellation for insufficient group numbers is permitted only if the minimum group size and the deadline for deciding to cancel were specified in the offer before the contract was concluded.
In extraordinary circumstances beyond the parties’ control, the Company notifies the Participant and takes available steps to mitigate the consequences within the scope of its intermediary duties. If services are cancelled before they begin, settlement and refunds are governed by sections 4–6 of these Terms. If services cease after they have begun, settlement for services provided and not provided, and the grounds and amount of compensation for any other losses, are determined by applicable law.
Amounts due for refund may be applied towards future services only with the Participant’s consent. Participants are advised to purchase their own non-refundable tickets only after their booking and the trip’s ability to proceed have been confirmed. This recommendation does not limit the Company’s statutory liability.
6. Refund procedure
Within the five business days following the day on which it receives the cancellation notice or another ground for a refund arises, the Company refunds any amounts due to the Participant that have not been transferred to the Partner.
If funds have been transferred to the Partner and are refundable, the Company promptly requests their return. The Company refunds funds received back from the Partner to the Participant within the five business days following the day of receipt. The Company keeps the Participant informed of the refund’s progress and must not delay it through its own inaction.
If additional payment details are needed to make the refund, the Company requests them promptly. The refund period is extended only by the time objectively necessary to obtain those details.
Refunds are made to the person who made the payment, using the original payment method, unless the parties agree otherwise in writing. Any such agreement must not unreasonably delay the refund. The time taken for funds to reach the recipient’s account depends on the bank or payment system. The Company does not charge a refund processing fee.
7. Participant requirements and associated risks
The Participant must assess whether their experience and physical fitness meet the programme’s requirements, taking account of altitude, climate, exertion and the remoteness of medical assistance. If in doubt, the Participant must consult a doctor. Approval of the application by the Company is not medical clearance.
In the application comments, the Participant must disclose any known medical conditions, injuries, allergies, medication or limitations that could materially affect safe participation or emergency assistance. A full medical history is not required. The Company shares necessary information with guides and the Partner only to the extent needed for their duties and on a lawful basis; additional health information is transmitted through secure communication channels. The Participant must promptly report material changes: before departure, to the Company; during the programme, to the Partner’s guide or the Company’s representative at the location where the services are provided.
The Participant must provide accurate passport details and the required documents by the deadlines stated in the offer, and must hold a valid passport, visas and permits, and the required insurance cover. Insurance must cover the programme’s entire duration and territory, the specified activities and altitude, medical treatment, accidents, search and rescue, evacuation and repatriation to the extent required by the offer.
The Participant must follow the lawful and reasonable instructions of the Partner’s leader and guides, comply with safety and environmental rules, use the required equipment and avoid endangering others. Taking part in high-risk activities while intoxicated and concealing material health limitations are prohibited. Where there is an objective safety risk, the Partner or its authorised leader may modify or end the Participant’s participation. The decision must be justified and proportionate, with reasons and safe options for what happens next explained where possible. Outdoor activities involve risks of falls, injuries, altitude sickness, sudden weather changes and delayed assistance; serious harm and death are possible. The Participant confirms that they have been informed of the programme’s inherent risks that cannot be eliminated and agree to participate with those risks in mind.
8. Liability of the parties
The Company is responsible to the Participant for properly performing its intermediary duties and carries out the mandate competently, with due care and diligence, and in accordance with applicable provisions of the laws of the Republic of Kazakhstan. It is responsible for the accuracy of the information it provides, due diligence in selecting the Partner, correct bookings, timely transfers of funds, delivery of documents and notices, and assistance in bringing claims. The Company provides evidence that it has carried out the mandate and an account of funds received and transferred, together with supporting documents. A contract with the Partner does not relieve the Company of its own intermediary duties or liability for breaching them.
Services are provided directly to the Participant by the Partner identified in the offer; the Partner engages the guides and route leader. The Company does not undertake to operate the programme, lead the route or directly provide accommodation, transport, meals or guiding services. The Company does not guarantee the Partner’s performance and is not liable for the Partner’s breach, except where liability is imposed by mandatory provisions of the laws of the Republic of Kazakhstan or arises from the Company’s own breach. The Participant may submit claims to the Company without first contacting the Partner. If the Partner is in breach, the Company informs the Participant, gathers the necessary evidence, pursues claims under the contract it has entered into and, at the Participant’s request, assigns its rights of claim to the Participant where such assignment is permitted by the laws of the Republic of Kazakhstan. Services purchased independently by the Participant and not included in the offer fall outside the scope of the mandate.
The Participant is responsible for the accuracy of their information and for meeting their obligations. The consequences of concealing material information, not having the required documents or breaching these Terms are determined with regard to proven causation, fault and applicable law. Illness or injury alone does not establish either party’s fault. A breach by the Participant does not relieve the Company of liability for its own acts or omissions.
To the extent permitted by applicable law, the Company is not liable for losses unrelated to a breach of its obligations, losses that it did not and could not have foreseen when the contract was concluded, or lost profits from the Participant’s business activities. These limitations do not apply to the Company’s liability for death or personal injury caused by its negligence or that of persons for whose acts it is responsible, or to liability for fraud or deliberate breach of obligations. Any Participant rights that applicable law does not allow a contract to restrict remain unaffected by these Terms.
9. Website and legal notices
Website materials may be used for personal preparation for the programme. Disrupting the website, bypassing its security, using another person’s data, and commercially copying materials protected by applicable intellectual property law without the rights holder’s permission are prohibited. Restricting access because of misuse does not terminate the Participant’s contractual rights.
The contract is concluded exclusively by acceptance of the offer through payment of the deposit within the stated period. The time of contract formation is determined by the Company’s receipt of the deposit. No exchange or signing of documents is required to conclude the contract.
The Participant must provide a working email address and promptly report any change. The Company sends confirmations, payment notices and legal notices to that address. A copy of the concluded contract is available to download on the status page as described in section 2. The Company uses [email protected] or another address specified in the offer.
Messages exchanged from the specified email addresses may be used to agree amendments to the contract, give notice of its termination and sign other documents relating to its performance, except where applicable law requires another form or method of signing. A message must allow the sender to be identified and clearly express their intention. An attached document is treated as signed by the sender if the message expressly agrees to it and unambiguously identifies the document. No additional handwritten signature or electronic digital signature is required in those cases. Correspondence alone does not constitute acceptance of the offer.
Each party must keep their email access credentials secure and promptly notify the other party if access is lost or obtained by an unauthorised person. Messages from an agreed email address are presumed to have been sent by the relevant party unless proven otherwise.
If a technical failure or an obvious error in information or a payment is discovered, the party concerned must promptly notify the other party so that the failure or error can be corrected. Such circumstances do not give either party a right to alter the concluded contract arbitrarily.
10. Claims, governing law and versions
Any problem on the route should be reported promptly to the Company’s representative or the Partner’s guide so that action can be taken. Claims are to be sent to the Company at [email protected], quoting the booking number and describing the circumstances. The Company considers the claim within a reasonable period and liaises with the Partner and other service providers where necessary.
The Company and the Participant agree that AIFC law, including the AIFC Contract Regulations, governs the contract and the relationship under these Terms. Disputes relating to the contract may be referred to the AIFC Court. The choice of governing law and provision for disputes to be heard by the AIFC Court do not restrict consumer rights under mandatory provisions of the laws of the Republic of Kazakhstan, including the right to bring proceedings before another court of competent jurisdiction. Applicable public-law requirements, including those governing tourism activities and the laws of the country where services are provided, must also be observed.
The Russian and English texts of these Terms must have the same meaning. The Participant receives the text in their chosen language; any discrepancy must not be interpreted to the detriment of consumer rights protected by mandatory provisions of applicable law. The version in force and accepted by the Participant when the contract was concluded applies; updates to the website do not automatically replace it. If a provision of the contract is invalid, the remaining provisions remain valid if the contract can be performed without that provision.
